The Patients’ Rights Program deals with patients’ rights guaranteed by the Act on Health Care and with other general patients’ rights issues. This program pays special attention to issues related to people’s right to make informed decisions about themselves, such as reproductive freedoms (abortion, contraception, artificial insemination, surrogacy, oocyte donation, home birth, etc.), the right to refuse treatment, euthanasia, and the rights of the intellectually disabled.

With its latest measures aiming to tighten regulations on medical sterilization, the government is about to intrude into the private lives of citizens. The proposal is another attempt at increasing the number of births – however, similarly to abortion regulations, the planned restrictions are not only inexpedient, but they also violate basic rights.

When the Fundamental Law came into force, HCLU publicly voiced its worries about the constitutional clause on the protection of the fetus which could lead to restrictions on abortion. The Fundamental Law states that along with the right to life and human dignity the fetus shall be protected from conception. The law on abortion has not been changed, however, the government has, through legal and non-legal means, tried to influence pregnant women which has come to undermine the right to self-determination. HCLU calls attention to the emerging problem with the following summary.

A conference was organized in the Hague at the end of May around the home birth case that HCLU won in Strasbourg. HCLU’s attorney dr. Tamás Fazekas represented Anna Ternovszky, in who’s case at the end of 2010 the European Court of Human Rights established that the State of Hungary has violated the applicant’s right to respect for private and family life, when in the absence of legislation it threatened (and still threatens) health care workers who assist at home births.

István Pálffy and Tamás Sáringer-Kenyeres, both MPs of the Christian Democratic Party (KDNP) have submitted a proposal to Parliament to reallocate funds from abortions to child protection and to incite adoptions. 45 organizations called the government’s attention to the fact that in case the Parliament were to adopt the proposal, the most vulnerable women would find themselves in even worse situations and that the proposal is against Hungary’s international commitments. The Parliament voted on the proposal on December 13th.
