Important FOI lawsuit develops: HCLU has won the case - the draft of the

HCLU has sued the head of the Ministry (Hungary’s Attorney General) for denying access to public interest data. The Minister referred to the requested document – draft of the new Constitution – as being important for decision making and should only be public after introduced to the Parliament. The court has dismissed the case accordingly to the Legislation Act and also the Electronic Freedom of Information Act. HCLU do welcome the decision since this very document definitely requires public debate. Usually the Parliament operates as a ‘law factory’ depriving both citizens and NGOs of all relevant information which makes them unable to articulate their opinion. The case of the Constitution of the EU illustrated the consequences of neglecting open and public debate.

Ezt a pert ugyebár jannuárban jogerősen elveszítette a TASZ. Ilyenkor nem illenék kitenni az ítéletet, csak ha nyernek?
